Terms of service

These terms are between you and Nineveh Ventures LLC, an Illinois limited liability company operating Nownex.app ("we"), and cover your use of Nownex.app at nownex.app. By creating an event you agree to them.

What you get

Per event: public pages for audience questions, a moderator view, stage displays, a schedule, and an archive with CSV export. Event Pro adds your branding and the generated print and screen kit. Current prices: Event Pass $19.99, Event Pro $29.99, each per event. An event is up to 14 consecutive days and up to 5 rooms; a longer program is more than one event.

Paying and refunds

• You build an event for free and pay once when you publish it. The price shown at checkout is the price.
• Full refund before the event starts. Delete the event from your dashboard before its first day and the whole payment, including any upgrade, is refunded automatically to the card you paid with (Stripe usually shows it within 5–10 business days). If you would rather keep the event as a draft, email us with the event name instead and we refund it by hand; the event then goes back to draft. Either way you get an email when the refund is issued.
• From the first day onward payments are not refundable, except where the service failed to work during your event. Tell us within 14 days of the event's last day and we will look at it fairly.
• You can move the event's days until the first day begins, as long as the event stays in the future and runs no longer than 14 days. Once the event starts, the days are fixed.
• Upgrading from Event Pass to Event Pro is charged as the difference and follows the same refund rule, with one exception: once any file of the event kit has been downloaded, the Event Pro portion of the price ($10) is no longer refundable, because those files have been delivered. Deleting the event before its first day then refunds the Event Pass portion.
• Nonprofit credit. Eligible US nonprofits, public schools and government organizations can receive one Event Pro event free. No card required. Eligible US organizations are (a) organizations the IRS recognizes as tax-exempt under section 501(c): charities, associations, civic leagues, churches and other faith bodies, and (b) public schools, colleges and government bodies that have an EIN. Apply from the dashboard; we verify by hand. One credit per EIN, so organizations that share an EIN share one offer. Valid for 12 months from approval, on any event you publish, with the usual 14-day and 5-room limits. No cash value, not transferable. Existing customers welcome. Your credit is restored if you delete the credited event before its first day, unless kit files were downloaded. We may decline an application with the reason emailed, and may revoke an unused credit for misuse.
• Events close automatically after their last day. The archive stays available to you.

Your responsibilities

• You are responsible for the content of your event pages, the logos you upload, and what your moderators approve for display.
• Moderator and presenter keys are shared secrets. Give them only to people you trust to run your rooms.
• Do not use the service to harass people, to publish content you have no right to, or to do anything unlawful.

Availability

We aim for the service to be available throughout your event and we run it on infrastructure built for that. We cannot promise it will never be interrupted. Stage displays keep showing their last state if their connection drops. If the service fails during your event, contact us and see the refund section above.

Limits

To the extent the law allows, our liability to you for anything arising from the service is limited to the amount you paid for the event concerned.

Ending an account

You can delete your events at any time from the dashboard. We may suspend an account whose events break these terms, or that is used for fraud or abuse; its public pages then go dark and you are emailed the reason, and you can reply to dispute it. We may close an account for serious or repeated breaches.

Governing law

These terms are governed by the laws of the State of Illinois, United States, without regard to its conflict-of-law rules. Any dispute that we cannot settle between us will be brought in the state and federal courts located in Illinois, and you and we each agree to that jurisdiction. If a court finds any part of these terms unenforceable, the rest still applies.
